Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sakra P.S. Case No. 631 of 2022 registered for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.

Learned APP, at the outset, submits that the offences for which the instant FIR has been instituted, carries punishment of 7 years or less.

Learned counsel appearing on behalf of the petitioner does not dispute the said submission of the learned APP.

On query of the Court, as to whether notice under Section 41A Cr.P.C has been given or not, on which the learned
Patna High Court CR. MISC. No.64282 of 2024(2) dt.24-01-2025 2/2 counsel appearing on behalf of the petitioner submits that notice under Section 41A Cr.P.C has been given to the petitioner. 6.
At this stage, learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application. 7.
Permission is accorded.

Accordingly, the instant anticipatory bail application is dismissed as withdrawn.
