Petitioner, already in custody, seeks bail in connection with Bettiah Town P.S. Case No.568 of 2016, giving rise to Sessions Trial No.185 of 2017, registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that informant is not the eye-witness and the eye-witness stated that six persons were involved in the occurrence. However, only allegation against the petitioner is that he caught the deceased and the allegation of assault with knife is against Kundan Raut, petitioner is in custody since 22.10.2017, he has no criminal antecedent and charge-sheet has been submitted in this case. Patna High Court Cr.Misc. No.57419 of 2017 (3) dt.17-01-2018 2 /2 specially that the allegation of inflicting knife blow is against Kundan Raut and not against the petitioner, petitioner Chandan Raut is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-2nd, Bettiah, District West Champaran in connection with Sessions Trial No.185 of 2017, arising out of Bettiah Town P.S. Case No.568 of 2016.
