2. The petitioners have preferred this application for grant of regular bail in connection with Raghunathpur P.S. Case No. 102 of 2025 dated 27.04.2025 registered for the offences punishable u/ss 103(1), 61(2) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, on 25.04.2024, when the informant was returning to his house then he saw that in front of the house of one Raktu Sahani, there were gathering and he saw that some persons have fled away after stabbing knife in the chest of his son, namely, Mustafa Ansari. It is further alleged

No.59967 of 2025(2) dt.03-09-2025 2/3 that the informant's son stated to the informant that the coaccused, Sudhir Sahani and Nitesh Kumar stabbed him with knife repeatedly in his stomach and chest. Thereafter, the informant took his son to the hospital where the doctor declared him dead. The informant apprehended that the accused persons named in the F.I.R. have committed murder of his son under conspiracy.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have been made accused in this case only because the petitioner no. 1 is the wife and the petitioner no. 2 is the mother of the co-accused, Sudhir Sahani. The specific allegation is against the co-accused persons namely, Sudhi Sahani and Nitesh Kumar. There is no specific allegation against the petitioners rather the allegation against the petitioners is general and omnibus. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged offence. The charge-sheet has been submitted against the petitioners. The petitioners are the ladies and they have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 27.04.2025.
5. Learned A.P.P. for the State has opposed the bail

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Motihari, East Champaran in connection with Raghunathpur P.S. Case No. 102 of 2025.
7. The application stands allowed.
