JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2017 Earlier prayer for bail of the petitioner was disposed of vide order dated 04.08.2017, passed in Cr. Misc. No. 33542 of 2017 with observation that petitioner may renew his prayer for bail after framing of charge in this case in the court below. Submission of learned counsel for the petitioner is that in the light of the above order of this Court, he has renewed his prayer for bail, however, the same was rejected. It has further been submitted that the petitioner is suffering from cancer and he may be allowed bail for his better treatment. Heard learned A.P.P. also.

Having heard both sides, in view of the submission of learned counsel for the petitioner that petitioner is suffering from cancer, the concerned court below is directed to get the petitioner

Patna High Court Cr.Misc. No.61176 of 2017 (2) dt.20-12-2017 2/2 examined by Medical Board to be constituted by Civil Surgeon, Jehanabad and if it is detected that petitioner is suffering from cancer, shall consider the prayer of the petitioner and shall pass an appropriate order.

With the above observation/direction, this application is disposed of.
