JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-09-2019 The petitioner apprehends his arrest in connection with Magadh Medical P. S. Case No. 67 of 2019 registered under Sections 147,148,149,307,323,337,338,353 and 504 of the Indian Penal Code and 30(a)(d) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner, as per FIR, is that police recovered total quantity of 1250 Kg Mahua flowers from the house of one Biral Manjhi and Chalitar Manjhi. It has further been alleged that when 20-25 persons tried to snatched the seized Mahua flower, the police apprehended two persons who disclosed the name of the petitioner and other accused persons as a dealer of the said Mahua Flower.

Learned counsel appearing on behalf of the petitioner submits that no Mahua flower has been recovered from the

Patna High Court CR. MISC. No.59760 of 2019(2) dt.24-09-2019 2/2 house of the petitioner and the name of the petitioner has transpired on the basis of his name having been disclosed by the villagers. Learned counsel further submits that similarly situated co-accused has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc. No. 33775 of 2019. Having regard to the submissions made by the parties and taking into consideration the fact that similarly situated coaccused person has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court, I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Magadh Medical P.S.Case No. 67 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
