2. The petitioner apprehends his arrest in connection with Piro P.S. Case No. 167/ 2018 dated 19.05.2018 registered for the offence(s) punishable under Section(s) 341, 323, 324, 325, 307, 354, 504 and 506 read with section 34 of the IPC

3. As per prosecution story, on 13.05.2018 at about 2.00 PM, firstly this petitioner uttered indecent language against the informant and when she objected, he abused her. It is further alleged that this petitioner assaulted the brother-in-law (Devar) of the informant causing head injury to him.

4. The main submissions advanced by learned counsel for the petitioner are that against the petitioner, there is no serious allegation and the FIR itself goes to show that the name of the petitioner was intentionally added in the mid portion of the FIR, some of the co-accused persons, namely, Kunti Devi @ Kanti Devi, Savita Devi and Deopal Ram have been granted anticipatory bail by the then co-ordinate benches of this court

Patna High Court CR. MISC. No.67182 of 2024(3) dt.17-12-2024 2/2 vide orders dated 15.02.2019 and 22.05.2019 passed in Cr. Misc. Nos. 9003 of 2019 and 33717 of 2019 respectively and the petitioner is alleged to have assaulted the brother-in-law of the informant who sustained simple injuriy.

5. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

6. Heard both the sides, perused the F.I.R, impugned order, case diary and the injury report of the injured persons.

7. The alleged occurrence is said to have taken place in the year 2018 and there is specific allegation against the petitioner that he assaulted at the head of brother-in-law of the informant which gets corroboration from his injury report.

8. Considering the nature of allegation mainly long absence of the petitioner from the police for several years, in my opinion, it is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, his prayer stands rejected. (Shailendra Singh, J) BKS/- U T
