The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a) and 41 (1) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 82 litres of country made liquor and 5.75 litres of foreign liquor, i.e., total 87.75 litres liquor was recovered from the dickey of tata indica car which was being boarded by two persons including the petitioner but nothing has been recovered from the conscious

Patna High Court Cr.Misc. No.55740 of 2017(2) dt.23-11-2017 2/2 possession of the petitioner who is said to be the driver of the vehicle. It is urged that the petitioner has remained in custody since 22.08.2017, i.e., about three months. It is claimed that the petitioner is having clean antecedent.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Buxar in connection with Buxar Nagar P.S. Case No. 517 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
