2. The petitioner seeks regular bail in connection with Sultanganj P.S. Case No. 56 of 2024 for the offences registered under Section 392 of the Indian Penal Code and Section 25(1b)a/ 26 of Arms Act.

3. It is alleged in the prosecution case that on the date of occurrence three miscreants are alleged to have looted four mobiles, Rs. 7,700/-, ATM Cards, PAN Card etc. on the gun point. It is further alleged that on the date of occurrence, one of the co-accused, namely, Sachin Kumar came and asked about the left motorcycle upon which he was apprehended and disclosed his name as petitioner. On search, one mobile, one live cartridge and Rs. 1,500/0 was recovered from his possession.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.65727 of 2024(6) dt.05-03-2025 2/2 petitioner is innocent and has falsely been implicated in this case only on suspicion. There is no recovery of looted item from the petitioner. He has four criminal antecedents out of which one is of Arms Act. It is further submitted that petitioner is on bail in other cases. Similarly situated co-accused namely, Anjo Kumar @ Sanoj Kumar has been granted anticipatory bail vide order dated 26.06.2024 passed in Cr. Misc. No. 38187 of 2024. He is in judicial custody since 11.02.2024. Charge has already been framed in this case. Petitioner undertakes to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1, Bhagalpur in connection with Sultanganj P.S.
