The petitioner is apprehending his arrest in Bihta P.S. Case No. 1230/2018 registered under Section 37(c) of the Bihar Prohibition and Excise Act, 2016.

The earlier anticipatory bail application of the petitioner was rejected vide Annexure-1 to the present application. This is the second attempt for anticipatory bail made on behalf of the petitioner.

It has been submitted on behalf of the petitioner that from perusal of the F.I.R., it would appear that at best a case under Section 37(b) of the Bihar Prohibition and Excise Act, 2016 is made out. There is no allegation in the F.I.R. against the petitioner for creating public nuisance or violence.

No.69608 of 2019(2) dt.27-09-2021 2/2 Since, the earlier anticipatory bail application of the petitioner was rejected, I am not inclined to consider the second anticipatory bail on behalf of the petitioner. If the petitioner surrenders in the Court below, the Court below will consider the submissions advanced on behalf of the petitioner and pass appropriate order(s) if an offence under Section 37(b) of the Bihar Prohibition and Excise Act, 2016 is made out. With the aforesaid observation, the present application stands dismissed.
