The petitioner is apprehending his arrest in connection with Araria (R.S.) P.S.Case No.589 of 2016 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that from the case diary itself it appears that allegation against petitioner is false and concocted. It has further been submitted that actually the petitioner has been implicated in this case due to village politics and earlier to this occurrence father of petitioner was also assaulted and he has received injuries and as it was village matter he was not lodged FIR, which is evident from Annexure-2.

Patna High Court Cr.Misc. No.3267 of 2017 (2) dt.09-02-2017 2/2 Heard learned APP also.

Having heard both sides and considering the fact that FIR shows that the petitioner was caught at the spot, I am not inclined to grant anticipatory bail to the petitioner. However, let the petitioner surrender and pray for regular bail in the court below, which will be consider and disposed of preferably on the same day the bail application is filed.
