Petitioner seeks bail in a case registered for the offences punishable under Sections 304B and 120B of the Indian Penal Code.

Petitioner is in custody since 15.03.2017 on suspicion that he committed murder of his wife as the petitioner was carrying illicit relation with his Bhabhi which was opposed by the victim.

The case diary would reveal that there is no eyewitness of the occurrence. However, the Doctor has found sign of throttling which was cause of death.

Learned counsel for the informant opposed the prayer for bail.

No.58220 of 2017 (3) dt.16-01-2018 2/2 Considering the material and period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gopalpur Police Station Case No. 26 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
