2.The accused/petitioner is named in the F.I.R. and apprehending his arrest in connection with Kanti P.S. Case No. 511 of 2021 registered for the offences punishable under Sections 30(a) of Bihar Prohibition & Excise Act.
3. The allegation against petitioner is that the petitioner found involved in illegal trading of illicit liquor from where a total of 262.305 litres of illicit liquor was recovered.
4. It is submitted by learned counsel appearing on behalf of the petitioner that name of petitioner
Patna High Court CR. MISC. No.64882 of 2024(3) dt.04-10-2024 2/3 transpired in this case only for the reason that he was involved in five more criminal cases of similar nature and merely on the ground of suspicion arising out of said criminal cases, his name was involved in present case. It is pointed out that admittedly recovery of illicit liquor was made from the house of co-accused Sonu Kumar and Rohit Kumar and name of this petitioner was transpired on the basis of secret information. It is submitted that the similarly situated co-accused, namely, Ankur Kumar was granted anticipatory bail by one of the learned Co-ordinate Bench of this Court in Cr. Misc. No. 16596 of 2023 dated 10.05.2023.
5. Learned APP opposes the prayer of bail.

Considering the aforesaid facts and circumstances, as recovery of illicit liquor prima-facie not appears from physical possession of this petitioner, accordingly the petitioner above-named in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail,
Patna High Court CR. MISC. No.64882 of 2024(3) dt.04-10-2024 3/3 furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise, Court No. II Muzaffarpur, where the case is pending in connection with Kanti P.S.
