JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-01-2019 Having regard to the scope of contempt jurisdiction, particularly, the law laid down by the Apex Court in the case of Union of India and Ors. vs Subedar Devassy, reported in (2006) 1 SCC 613, while exercising the contempt jurisdiction, this Court is only required to examine the direction issued by the writ Court and not to enlarge the scope of contempt jurisdiction and issue fresh direction.

Considering the aforesaid law laid down by the Apex Court and the order passed by the Veer Kunwar Singh University in compliance of the order of the writ Court, the Court is not in a position to proceed any further in the matter,

Patna High Court MJC No.4294 of 2016(4) dt.21-01-2019 2/2 accordingly, this application stands disposed of. However, liberty shall be available to the petitioner to approach the appropriate forum challenging the order of the University dated 02.08.2016.
