====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 10-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Chakiya P.S. Case No. 315 of 2024, registered for the offences under Section 309(4) of the BNS.

3. As per the prosecution case, three miscreants riding a motorcycle, on gun point, snatched the gold locket of the informant and took away Rs. 20,000/- and a shoulder bag containing a projector. The name of the petitioner transpired during investigation for being involved in the said robbery.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case on the basis of confessional

Patna High Court CR. MISC. No.61993 of 2025(2) dt.10-09-2025 2/3 statement of the petitioner which was recorded in Chakiya P.S. Case No. 316 of 2024. Such statement has no legal sanctity. No looted article was recovered from this petitioner and even during investigation no cogent material was collected by the police against the petitioner. Charge sheet has been submitted and the petitioner is in custody since 21.11.2024 but till date no Test Identification Parade has been carried out. The petitioner is having antecedent of three cases and he is on bail in all such cases.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet against him, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned J.M.F.C., East Champaran at Motihari/concerned court, in connection with Chakiya P.S. Case No. 315 of 2024, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
