1. Heard learned Counsel for the parties concerned.

2. Learned Counsel for the petitioner submits that the petitioner is the owner of the land, but the respondent nos. 9 to 11 are disturbing the petitioner from cultivating his land. Referring to the contents of the counter affidavit, he

Patna High Court CR. WJC No.1403 of 2021(5) dt.28-08-2023 2/2 submits that the respondent-State has stated that the petitioner may file an application, along with requisite fee, for measurement of the land, in question, before the Circle Officer, Naubatpur, who would take necessary action for the measurement of the land through Circle Amin.

3. In view of the nature of dispute and the statement made in the counter affidavit filed on behalf of the State, this writ application is disposed with liberty to the petitioner to file an application before the Circle Officer, Naubatpur, for measurement of the land, in question.

4. It is made clear that if an application is filed by the petitioner for measurement of the land before the Circle Officer, Naubatpur, along with the requisite fee, the Circle Officer, Naubatpur, shall get the land measured in accordance with law.
