Petitioner apprehends arrest in connection with Jadopur (Yadopur) P.S. Case No. 187 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from the bank of Chiran river, which is an open place. Petitioner has no concern with the seized article.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the

Case No. 187 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
