The petitioner seeks anticipatory bail in connection with Complaint Case No. 16-C of 2016, registered for offences punishable under Sections 406 and 420 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is that the petitioner agreed to sell his land to the informant for a sum of Rs.4,91,000/- and he had given Rs.4,11,000/- and Rs.80,000/- was due to the informant and now he has not executed the sale deed.
Submission of the learned counsel for the petitioner is that the land in dispute has already been purchased by the petitioner from the husband of the informant and the present
Patna High Court Cr.Misc. No.45978 of 2018(2) dt.08-08-2018 2/2 case is a false and concocted and also the police after investigation has not found the case is true and final form has been submitted and the cognizance has been taken against him and the petitioner has no criminal antecedent. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I, Kishanganj, in connection with Complaint Case No. 16-C of 2016, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
