JUSTICE ARUN KUMAR ORAL ORDER 13-02-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Narpatganj PS Case No. 259 of 2017 registered under Sections 147, 149, 341, 342, 323, 324, 325, 326, 307, 379 and 504 of the IPC. The allegation in brief is that the petitioners and others assaulted the informant side. The specific allegation against petitioner No. 1 Manoj Sharma is that he gave a farsa blow caused injury on the left arm of the informant and petitioner No. 2 Santosh Sharma gave sword blow on the neck of the informant. Learned Counsel for the petitioners submits that there is case and counter case between both sides, there is land dispute between them and so called injury are said to be grievous but only skin deep, however both sides are agnates.
Having considered the said facts and circumstances, the petitioner, namely, Manoj Sharma and Santosh Sharma are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by both of them with two sureties of the like amount each to the satisfaction of CJM Araria in connection with Narpatganj PS Case No. 259 of 2017.
