JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hussainganj P.S. Case No. 137 of 2016 registered under Section-7 of the Essential Commodities Act.
176 bags of rice each containing 50 Kg. rice and 121 bags of wheat were recovered from the flour mill of the petitioner and the informant claims that the aforesaid grains had been stored by the petitioner for black marketing. Submission on behalf of petitioner is that there is no limit on the storage of wheat and rice. Moreover, there is nothing on the record to show that the aforesaid seized grains had been lifted under any government schemes.

No.536 of 2017 (2) dt.13-01-2017 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Hussainganj P.S. Case No. 137 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Siwan subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
