JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Medni Chowki P.S. Case No. 07 of 2018 instituted for the offence under Sections 376, 420 and 506/34 of Indian Penal Code.
Counsel for the petitioner submits that in the written report the victim girl (informant) has stated that petitioner has established physical relationship with her for last three years but she never lodged any case against the petitioner. Counsel for the petitioner further submits that victim girl (informant) has filed the instant case merely to give pressure upon the petitioner to perform marriage with her.

Patna High Court Cr.Misc. No.59523 of 2018 (2) dt.06-10-2018 2/2 years on the pretext of performing marriage with her, but finally he did not agree to perform marriage.
Even if the allegation is taken to be true, then the entire act was done with consent of the informant. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-2nd, Lakhisarai, in connection with Medni Chowki P.S.
