JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sherghati (Dobhi) PS Case No. 324 of 2017 registered under Sections 25(1B)A/26 of the Arms Act. It is alleged that one country made pistol and two live cartridges were recovered.

It is submitted that the petitioner has falsely been implicated, there is no independent witness of seizure list. However, the petitioner is in custody for last seven months. The police has submitted charge-sheet.

Having considered the said facts and circumstances, the petitioner, namely, Anup Kumar Yadav @ Anup Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Sherghati, Gaya in connection with Sherghati (Dobhi) PS Case No. 324 of 2017, with the condition that one of the bailors shall be a close family member of the petitioner. The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of medical emergency his bail bonds shall be liable to be cancelled.
