The petitioner seeks bail in Ishakchak P.S.Case No.32 of 2018 registered for the offence under Sections 395, 397 and 412 of I.P.C.

Allegation as per the F.I.R. is that some miscreants entered inside the house of the informant and looted the articles of the house away. There is recovery of some articles from the house of the petitioner and Amit Sah and Vikash Sah both happened to be the elder brothers of the petitioner. Submission of the learned counsel for the petitioner is that he has not been named in the F.I.R. rather his name has come on the basis of confessional statement of co-accused, namely, Amit Sah and Vikash Sah who having similarly situated

Patna High Court Cr.Misc. No.67982 of 2018(2) dt.29-11-2018 2/2 have already been granted bail by coordinate Bench of this Court vide order dated 29.06.2018 passed in Cr.Misc.No.36081 of 2018 which will appear from Anneure-2.Nothing has been recovered from his possession nor he has been put on test identification parade. He is in custody since 13.06.2018. Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M.,Bhagalpur, in Ishakchak P.S.Case No.32 of 2018 / G.R.No.550 of 2018 with condition that bailors of the petitioner shall be of local having sufficient immovable properties within the jurisdiction of the court concerned.
