1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of regular bail, arises out of Lakhisarai Police Station Case No. 22 of 2023, disclosing offences under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, lodged by the informant/chowkidar, that while he was patrolling in the locality, he was informed by the villagers that unidentified body of a lady was lying in a ditch. As per the information, he reached at the place of occurrence and found the dead body of the lady having two gun shot injuries on her head and hand.

4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and has been implicated in

Similarly situated co-accused persons namely Saurav Kumar and Raju Kumar whose name was also disclosed by the coaccused Sachin Kumar in his confessional statement, have been granted regular bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 44963 of 2023 and Cr. Misc. No. 61761 of 2023. The petitioner is in custody since 26.06.2024.

5. Regards being had to the submissions made by the parties and taking into consideration the fact that similarly situated accused persons have been granted bail by a Bench of this Court, I am inclined to grant regular bail to the petitioner.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection to the Lakhisarai Police Station Case No. 22 of 2023, disclosing offences under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

7. This is subject to the condition that the petitioners shall present themselves before the Court, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be
