JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 The petitioners seek regular bail in connection with Excise Case No. 292c2/18, registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 233 litres of liquor from the vehicle of the petitioners.

It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and they are only co-passengers of the vehicle without having knowledge of the liquor. Further they have no criminal antecedent and have been in judicial custody since 03.10.2018 and co-accused, who is the driver of the said vehicle has already been enlarged on bail by a

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner sabove named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. -II, Jamui, in connection with Excise Case No. 292c2/18.
