The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30(a)(d) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 20 litres of mahua wine was recovered from the hut belonging to the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the hut or possession of the petitioner, who is a lady having no criminal antecedent. She is in custody since 13.11.2021. Heard learned APP for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.71938 of 2021(2) dt.07-06-2022 2/2 taking into consideration the petitioner not having any criminal antecedent and having remained in custody for more than 6 months, the petitioner is directed to be enlarged on bail in connection with Atri P.S. Case no. 309 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II - cum - Special Judge, Excise Act, Gaya.
