JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-05-2016 The petitioner retired from the service of Bihar State Food and Civil Supplies Corporation Limited on 31.1.2013. He filed the instant writ application for payment of retrial benefits. It appears from the order, dated 18.12.2014 that the petitioner has already been handed a cheque of Rs.3,98,552/- covering gratuity and leave encashment.

Patna High Court CWJC No.23191 of 2013 (9) dt.10-05-2016 Both learned counsel appearing on behalf of the Corporation as well as Mr. P.K. Verma, learned Senior counsel appearing for the Provident Fund Commissioner submits tha t the petitioner has not been paid the benefit of provident fund contribution and pension for want of submission of appropriate form. It is further submitted on their behalf that time and again the petitioner has been requested to submit appropriate form for favour of the aforesaid benefit.

Having regard to the facts and circumstances of the case, this writ application is disposed of in the following terms: i) The petitioner would, as expeditiously as possible, submit appropriate form duly filled in, to the District Manager of the Corporation, Rohtas branch who would immediately forward the same to the Assistant Commissioner, EPF, Patna ii) On receipt of such form, the Assistant Commissioner, EPF, Patna would forthwith release admissible benefits in favour of the petitioner.
