The petitioner apprehends his arrest in connection with Kazimohammadpur P.S. Case no. 155 of 2019, registered under Section 366(A) of the Indian Penal Code. The accusation is that daughter of informant Sagir Alam, aged about 16 years, left the house on 6th April without giving any information. Thereafter, informant searched his daughter at several places, but no trace was found. In course of search, the informant came to know that a lodge situated in front of his house, Md. Naseem @ Vicky, son of Kalam, resident of Saidpur, P.S. Runni Saidpur, District- Sitamarhi used to reside, who, occasionally, talk to his daughter and he also used to tease his daughter during the course of going to school. The informant claimed that Md. Naseem @ Vicky in connivance with his associates, namely, Md. Ajhar, Dilshad @

Patna High Court CR. MISC. No.76364 of 2019(10) dt.27-01-2021 2/2 Khurram and Md. Shoeb (Petitioner), who also used to reside in the lodge and his parents kidnapped his minor daughter. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case as he also used to reside in lodge in front of the house of informant. In course of investigation, in paragraph No. 25 of the case diary, it has come that informant talked on phone to his daughter on 11.07.2019 bearing mobile No. 9155153147, which belongs to Satyam and daughter of informant also informed the informant that she is at Odisha, but, thereafter, informant could not talk to his daughter. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-I-cum-Spl. Judge, Muzaffarpur in connection with Kazimohammadpur P.S. Case no. 155 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
