Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under sections 302, 307 of the Indian Penal Code.

Some altercations took place between the informant and the accused persons and as per allegation, co-accused Pramod Kumar, Subhash Kumar along with other accused persons badly assaulted the informant, his father Prabhu Singh, uncle Bajrangi Singh and cousin brother Tinku Singh. Prabhu Singh, father of the informant died in way to the hospital.

She is lady of clean antecedents and is in custody since 12.07.2021. He has submitted further that co-accused Pramod Kumar, Korelal Singh and Bablu Singh against whom there was allegation of inflicting assault on the deceased were granted bail by a Coordinate Bench of this Court. The case of present petitioner is on better footing. On the other hand, learned Addl. APP opposes the prayer for bail.

Considering the facts and circumstances, clean antecedents and the period of custody of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Ashwani Kumar, Judicial Magistrate, Ist Class, Munger in connection with Sangrampur (Tetia Banbar) P.S. Case no. 139 of 2020, subject to the following conditions:- 1.

The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. 2.

If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
