The petitioner seeks bail in Inarwa P.S.Case No. 43 of 2018, registered for the offences punishable under Section 376 of the Indian Penal Code including section 6 of the Protection of Children from Sexual Offences Act.

Considering the statement of the victim recorded under Section 164 Cr. P.C., which has been brought on record by way of Annexure-2, from which it appears that the offence under the provision of the POCSO Act is made out, I am not inclined to grant bail to the petitioner. Despite the submission made by the learned Senior Counsel, appearing on behalf of the petitioner that there is substantial difference between the contents of the FIR and the statement of the victim recorded

Patna High Court Cr.Misc. No.70493 of 2018(2) dt.04-12-2018 2/2 under Section 164 Cr. P.C., this application is accordingly rejected.

The Court expects that the trial shall be expedited and concluded within six months.
