1. Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.
2. The accused/petitioner is named in F.I.R. and apprehending his arrest in connection with Lalganj P.S. Case No. 02 of 2023, registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code.
3. The allegation against the petitioner is to fraudulently transfer the cash received for execution of 'Nal Jal Yojna', a welfare scheme of Government of Bihar, where allegation is to defalcate the amount of Rs.
Patna High Court CR. MISC. No.65198 of 2023(5) dt.10-05-2024 2/3 6, 45,000/-.
4. Learned counsel appearing on behalf of the petitioner submitted that the entire work on part of petitioner is now completed for which the sanctioned fund stands fully utilized. It is submitted that out of local political differneces, the present petitioner was falsely implicated without having any cogent materials. While concluding the argument, it is submitted that petitioner is a man of clean antecedent.
5. Learned APP appearing for the State while opposing the prayer of bail submitted that the petitioner now completed the work and also utilized the funds sanctioned for the same purpose.
6. Considering the aforesaid factual submissions, as implication of petitioner prima facie appears for delaying the project and utilization of Government fund, which now no more exists, coupled with the fact that petitioner is a man of clean antecedent, accordingly, the above named petitioner, in

No.65198 of 2023(5) dt.10-05-2024 3/3 the event of his arrest or surrender before learned trial court within a period of four weeks, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, II, Vaishali at Hajipur/concerned Court, where the case is pending in connection with Lalganj P.S. Case No. 02 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
