Petitioner apprehends arrest in connection with Lalganj P.S. Case No. 125 of 2018 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely on basis of suspicion. Petitioner is neither the owner nor the driver nor the khalasi of the truck in question. As a matter of fact, petitioner has no concern with the alleged trucks. Petitioner resides at a place 20 Kms away from the place of occurrence. Moreover, similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court vide order dated
Patna High Court Cr.Misc. No.73941 of 2018(2) dt.18-12-2018 2/2 04.07.2018 passed in Cr. Misc. No. 37838 of 2018, as contained in Annexure-3. Petitioner is a man of clean antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 125 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
