2. The petitioner is in custody in connection with Mojahidpur (Babarganj) P.S. Case No. 359 of 2022 for the offence under Sections 341, 307, 302, 120B read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per F.I.R, five accused persons shot the deceased.

4. Learned counsel for the petitioner submits that the petitioner has got one criminal antecedent and he is in custody since 03.04.2023. He further submits that petitioner is not named in the F.I.R. He is innocent and has falsely been implicated in this case.

5. The petitioner is not named in the F.I.R and there is no specific allegation against him. The name of the petitioner

6. Considering the aforesaid facts and period of custody, the petitioner, named above, is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District Judge8th, Bhagalpur in connection with Mojahidpur (Babarganj) P.S. Case No. 359 of 2022.

7. The petitioner will visit Babarganj Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
