The petitioner seeks bail in C.B. Case No.70 of 2016 registered under Section 30(a), 47(a) of the Bihar Excise Amendment Act, 2016.

The prayer for bail of the petitioner was firstly rejected on 22.03.2017 passed in Cr. Misc. No.12431 of 2017. The petitioner again moved for his bail in Cr. Misc. No.26015 of 2017 and the same was rejected on 28.06.2017 with an observation that the petitioner may renew his prayer for bail after remaining one year in custody.

Mr. K.N.Choubey, learned senior counsel for the petitioner submits that the petitioner is in custody since

Patna High Court Cr.Misc. No.60802 of 2017 (2) dt.24-01-2018 22.10.2016. Petitioner has already remained in jail for about 15 months.

Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-cumA.D.J. VIIIth, Patna in connection with C.B. Case No.70 of 2016 arising out of Special Case No.1819 of 2017.
