====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sarai P.S. Case No. 141 of 2018 instituted for the offence under Sections 363, 366A and 34 of the Indian Penal Code.

The informant Lilawati Devi filed written report on 12.7.2018 alleging that she was living along with her family at Mumbai where accused Imtiyaz Ansari (petitioner) was also residing. It is alleged that accused Imtiyaz Ansari used to visit her house and talk to her daughter Khushbu Kumari. It is further alleged that informant came to her native place two months before along with her daughter but her daughter used to talk with petitioner on telephone. She alleged that on 1.7.2018, the petitioner took her daughter to unknown place with intention to perform marriage with her with the assistance of

The victim girl after recovery has given statement under Section 164 Cr. P.C. wherein she has stated that she had voluntarily gone with this petitioner and established physical relationship with him. She has also performed Nikah with him. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIII, Hajipur, in connection with Sarai P.S. Case No. 141 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
