JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 13-03-2015 Petitioner is the husband, who apprehends arrest in Begusarai Mahila P.S. Case no. 46 of 2013 instituted under sections 498-A/34 of the Indian Penal Code and also under section 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner points out that the complaint to the Mahila Police Station was lodged on 02.08.2013 whereas the informant herself has left the house on 17.07.2012, where after the petitioner had filed a case before the Principal Judge, Family Court, Begusarai for restitution of conjugal right on 28.08.2012. Subsequently there being no cohabitation, when the petitioner came to know that the informant had become pregnant, he withdrew the restitution case and had also filed a divorce case being Divorce Case No. 130 of 2013. It

Patna High Court Cr.Misc. No.36158 of 2014 (2) dt.13-03-2015 is in retaliation to this that the present case has been lodged by the informant.

Be that as it may, in the event of arrest or surrender of the petitioner within four weeks from today, the petitioner above named shall be released on bail on furnishing bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Begusarai in connection with Begusarai Mahila P.S. Case No. 46 of 2013 subject to all conditions as laid down in section 438(2) of the Code of Criminal Procedure, 1973. (Navaniti Prasad Singh, J) Amin/- U
