The application is for grant of bail for the offence under Section 395 of the Indian Penal Code and Sec. 3 /4 of Explosive Substance Act.
It is submitted on behalf of petitioner that on the basis of confessional statement of co-accused he has been implicated in this case whereas other co-accused has already been granted bail by the Hon'ble court.
Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail and submitted that he is also convicted in some other cases.
Having heard both sides. In view of the fact that
Patna High Court Cr.Misc. No.581 of 2017 (2) dt.12-01-2017 2/2 though he is convicted in some other cases but in the present case, there is nothing against the petitioner except confessional statement of co-accused in which his name transpires and petitioner is in custody in connection with this case for about 8 months, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah (West Champaran) in connection with Shikarpur P.S. case no. 352 of 2012 with a condition that he will cooperate in the trial and make himself available on each and every date except on some genuine reason otherwise his bail bond will be cancelled.
