JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code. As per the prosecution case, on 28.04.2021 at about 5 PM husband of the informant left the house along with co-accused Sonu Sao and thereafter she came to know that her husband had been killed by the FIR named accused persons, including this petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has been implicated in the case only on suspicion. During the course of the investigation none of the witnesses has stated that this petitioner was seen committing the murder of husband of informant. Save and except suspicion there is no material against this petitioner to show his involvement in the aforesaid crime. On the relevant day, petitioner was engaged in Chauthari function at his house. Patna High Court CR. MISC. No.72142 of 2021(3) dt.28-04-2022 2/2 and is in custody since 27.06.2021 and investigation in this case is complete. Similarly situated co-accused Sonu Sao has already been allowed bail by this Court vide order passed in Cr.Misc.No. 67929/2021.

Learned counsel appearing for the State opposes the prayer for bail and submits that it is a case of circumstantial evidence and petitioner was last seen with the deceased. Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Patna in connection with Parsa Bazar PS case No.153/2021, GR No. 3692 of 2021.
