Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272, 273, 414, 120(B)/34 of the Indian Penal Code and section 30(a)/41(1) of Bihar Prohibition and Excise Act.

As per prosecution case, 2653.2 liters of country made liquor has been recovered from a truck in an orchard. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is neither the driver nor owner of the truck in question. No incriminating material has been recovered from the conscious possession of the petitioner. Name of the petitioner transpired during the course of investigation. Petitioner has got no criminal

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the Court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. -1, Muzaffarpur, in connection with Minapur P.S. Case No. 212 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
