The petitioner is languishing in custody since 28.03.2014 in a case registered for the offences punishable under Sections 467, 468, 406 and 409 of the Indian Penal Code. It is alleged that the petitioner received the advance of Rs.1,88,275/- for payment of diesel subsidy and Rs.22,789/- for maize subsidy but detail of the distribution was not submitted, hence, it was suspected that the amount has been misappropriated.

It is submitted by learned counsel for the petitioner that the subsidy has been distributed to the respective beneficiaries and this fact has been admitted by the Panchayat

Patna High Court Cr.Misc. No.36564 of 2014 (03) dt.13-01-2015 2/2 Mukhiya, whose statement has been recorded in paragraph 38 of the case diary.

Considering the period under custody and the fact that the investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sikrahna at Motihari in connection with Chiraiya P.S. Case No. 135 of 2013.
