The petitioner seeks bail in connection with Govindpur P. S. Case No.51 of 2021, instituted for the offences under Sections 30(a) and 41 of the Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 20.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 200 litre of liquor from a bag tied to the motorcycle.

The learned counsel for the petitioner submits that petitioner was not arrested from the spot. His name disclosed by a minor, who was arrested by the police.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and his name came in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Nawada in connection with Govindpur P. S. Case No.51 of 2021.

The application stands allowed.
