Petitioners apprehend arrest in a case registered for offence under sections 467, 468, 476, 406, 420 and 120B of the Indian Penal Code.

It is submitted on behalf of the petitioners that from perusal of annexure 2 it would be evident that the sale deed has finally been executed in favour of complainant. He submits that the allegation made in the FIR are predominantly civil in nature and in view of annexure 2 no dispute remains between the petitioners and the complainant. Prior to the instant case, there is no criminal antecedent of the petitioners.

Considering the aforesaid submissions and the facts

Patna High Court Cr.Misc. No.74871 of 2018(2) dt.19-12-2018 2/2 and circumstances of the case, prayer for bail to both the petitioners is allowed. In the event of arrest/surrender within four weeks from today, let the petitioners as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Sasaram Rohtas in Sasaram Darigaon Police Station Case No. 1287 of 2016 on the following conditions:- on the following conditions:- One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and The Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
