====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 19-12-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 353, 504, 506, 188 and 34 of the Indian Penal Code and Section 51 of the Disaster Management Act.
The informant alleges that one Covid patient Suresh Kumar aged about 62 years was brought to the Sub-divisional hospital, Dumraon but seeing his condition, he was referred to Buxar for better treatment on which his relative including the petitioners became aggressive and assaulted the doctors. Learned counsel for the petitioners submits that the

No.64021 of 2022(2) dt.19-12-2022 2/3 petitioner no. 1 is a person with clean antecedent and is a woman and petitioner no. 2 has antecedent of one case and is a young boy aged about 22 years and have been falsely implicated in the present case, it is next submitted that petitioner no.1 is daughter-in-law of Suresh Singh and petitioner no. 2 is grandson of Suresh Singh who subsequently died during the course of treatment, it is also submitted that when he was brought to the hospital, at that time, no first aid was given to him and the doctors were not willing to treat and made the same as an excuse and as such, the relatives became aggressive. Learned counsel next submits that in such situation the reaction is very normal, it is also submitted that no injuries were suffered by the informant or any staffs of the hospital.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is
