The petitioner has moved before this Court for issuance of writ directing the respondents to consider the case of the petitioner for appointment on Class III post on regular pay scale, in place of Class 4th Post as class 3rd posts are still vacant and were vacant at the time of his appointment on Class 4th post on compassionate ground, but his position and eligibility were overlooked by the authorities concerned.

Learned counsel for the petitioner submits that the petitioner has already filed a representation before the respondent no.1 (Annexure-P/3) but till date the representation

Considering the submission of the learned counsel for the petitioner, respondent no.1 is directed to dispose of the case of the petitioner after affording opportunity of personal hearing or through his counsel and pass a reasoned and speaking order in accordance with law within eight weeks thereafter. 5.

It is made clear that respondent no.1 shall be liable for non-compliance of this order within the stipulated period. 6.

With the aforesaid direction, this writ application stands disposed of.
