Petitioner seeks bail in a case registered under Section 30 (a) of Bihar Prohibition and Excise Act.

It is submitted by the petitioner's counsel that allegation is of recovery of 168.480 liters of wine from part of the petitioner's house which is under construction. The recovery in question is contrary to the procedure prescribed under Section 100 of Criminal Procedure Code. Petitioner, having no criminal antecedent, is in custody since 20.10.2018. Considering the aforesaid submissions and the facts and circumstances of the case, petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
