JUSTICE BIRENDRA KUMAR ORAL ORDER 03-03-2017 Heard learned counsel for the petitioners, learned counsel for the informant and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341/323/379/504/506/308/34 of the Indian Penal Code. There is general and omnibus allegation against petitioner Nos.1 and 2 to have caused injury to the informant for some dispute relating to cutting of the ridges of the field. Further allegation is of commission of theft of ornament from the person of the informant. There is case and counter case.
Patna High Court Cr.Misc. No.5225 of 2017 (2) dt.03-03-2017 2/2 Submission of the petitioners is that the doctor has found simple injury. However, it is opined that injury No.1 may be endangered to life.
Learned counsel for the informant opposed the prayer for bail.
Considering the facts and circumstances and general and omnibus allegation against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Nalanda at Biharsharif/Successor Court in connection with Manpur Police Station Case No.84 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
