Heard the learned counsel for the petitioner and learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, registered in connection with Khaira P.S.Case No. 289 of 2021. As per allegation, 20 litres of liquor was recovered from the possession of the petitioner.

The learned counsel for the petitioner has submitted that he is in custody since 02.09.2021 merely on the basis of his

Considering the above facts and circumstances as well as the period of detention, let the petitioner above-named be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Saran at Chapra in connection with Khaira P.S.Case No. 289 of 2021. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
