Petitioner seeks bail in S.T. No. 649 of 2018 arising out of Bakhtiyarpur GRPS Case No. 226 of 2017 registered under Section 395 of the IPC.

It is submitted by the Counsel for the petitioner that on the confessional statement of co-accused Gaurav Kumar and Manish Kumar the petitioner has been implicated in this case. Manish Kumar, on whose confessional statement he has been implicated, has also been allowed bail by this Court in Cr. Misc. No. 30428 of 2018. He submits that other similarly situated coaccused have also been allowed bail in Cr. Misc. No. 47113 of 2018. There is no recovery from the petitioner and he uis in custody since his voluntary surrender in the court on 11.7.2018.

Considering the aforesaid submissions as also the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, 4th, Patna in S.T. No. 649 of 2018 arising out of Bakhtiyarpur GRPS Case No. 226 of 2017 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled. .
