JUSTICE SATYAVRAT VERMA ORAL ORDER 13-05-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.08.2021, charge-sheet has been submitted in this case and has antecedent of three cases. The learned counsel for the petitioner submits that the informant alleges that he was intercepted by four unknown accused persons, who at the point of gun, looted his pick-up van along with Rs.2,000/- in cash.

The learned counsel for the petitioner submits that the F.I.R. was against unknown. The petitioner, who was standing near a garage was caught by the police based on suspicion and later, police came to know he has antecedent, he was implicated

Patna High Court CR. MISC. No.72335 of 2021(2) dt.13-05-2022 2/2 in the present case. The learned counsel submits that petitioner was not put on T. I. Parade, nor any incriminating article was recovered from his possession.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sasaram (Darigaon) P. S. Case No.656 of 2021, subject to condition that one of the bailors shall be the father of the petitioner namely, Anil Kumar Singh.

However, if the learned Court below comes to a conclusion that the petitioner after his release is trying to delay the trial proceeding in any manner, the learned Court below shall forthwith cancel his bail bonds after recording reasons. The application stands allowed.
