2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 103 and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act. 3 . The prosecution case , in brief is that informant namely, Md. Saudagar alleged that on 15.02.2025 , all the F.I.R. named accused persons including this petitioner called brother of informant and asked to steal ATM. Upon denial, this petitioner along with other accused persons assaulted him brutally and pressed his neck as a result of which he died.
4. Learned counsel for the petitioner submitted that petitioner is not alleged to have fired upon the deceased. As per F.I.R. this petitioner along with other co-accused persons
Patna High Court CR. MISC. No.59926 of 2025(3) dt.21-11-2025 2/2 pressed the neck of the deceased but in post mortem, doctor has not found any external injury on the neck of the deceased. Petitioner claims clean antecedent and is in custody since 19.06.2025 .
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, period of custody and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IV Patna in connection with Phulwari P. S. Case No. 251 of 2025 .
