1. The present petition has been filed for restoration of a contempt petition bearing MJC No.230 of 2020 which has stood dismissed on account of non-prosecution, by an order dated 31.08.2022.

Patna High Court MJC No.2126 of 2022(3) dt.17-05-2024 2/2 submitted that the counsel for the petitioner had fallen ill suddenly and therefore, he could not appear, when the case was called out for hearing on 31.08.2022, resulting in dismissal of the aforesaid contempt petition on account of non-prosecution, thus a sympathetic view be taken and the aforesaid petition be restored to its original file.

3. Having regard to the submission made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and proper to restore the aforesaid contempt petition bearing MJC No.230 of 2020 to its original file.
